commercial agreement must be credited by a service contract, "Agency
Agreement". This contract must be legalized and registered in the
Servicios de Aduanas de Chile. This is a Customs' regulatory obligation
due to responsibilities of a correct Declaration of Goods Entry and
right control of the economic agents that intervene in foreign trade.
Any discrepance that exceeds allowed limits related to gross weight (+/- 5%) a fine up to 200% of CIF/US$ value will be applied. If this fine exceeds US$ 2,000.00, discharges shall be presented by a Lawyer, whose fees are of 20% over the total of the reduced fine. If discharges are accepted, the minimum fees for this kind of suit are US$ 250.00. If this fine exceeds US$ 2,000.00, discharges shall be presented by a Lawyer, whose fees are of 20% over the total of the reduced fine. If discharges are accepted, the minimum fees for this kind of suit are US$ 250.00. If fine is less than US$ 2,000.00, discharges and procedures before Customs will be able to be carried out by our office and expenses would be US$ 75.00 plus US$ 35.00 per each attendance to the customs court. In global terms it must be considered 3 citations, notification, presentation of discharges and knowledge of penalty or exemption. All this will depend on the reasons and antecedents that will be given.
Presentation out of period of the documentation of Cargo Manifest Clarification: All documentation related to ocean shipments, which will be received by Chilean Customs, must be presented with a minimum of 7 working days to the arrival of the ship. If presentation and clarification is done out of the period of time allowed, Customs will apply a fine up to US$ 50.00 per each shipment not declared. Those kinds of bulk or erroneous declaration of minor importance, can be sanctioned and fined. In general terms, a fine of US$ 20.00 to US$ 25.00 can be applied in this case, due to each erroneous declaration denounced.
Fines due to delay in presentation Whenever the documentation of the shipment is presented before Customs after 5 working days to the arrival of the container, Customs will fine Magallanes Forwarder Chile S.A. per each House B/L. In case of consolidated cargo, fines will be charged to the issuance agent. (These fines are US$ 15.00 to US$ 30.00 x H B/L).
Fines due to Weight Differences When one or more House B/L is covered by a Master B/L, the total weight of all H B/L must sum up total weight on the Master B/L. Any difference of weight in the documents will be a fine to Magallanes Forwarder Chile S.A. and shall be paid by the issuance agent. in case of difference between real weight and declared weight in the H B/L, a fine equal to the taxes will be generated. This fine will be paid over the difference of weight.
